What is Proposition 65?

Proposition 65 – or “Prop 65” – is a California regulation that was passed into law in 1986. It requires that a clear warning is provided on foods and beverages in which an individual could be exposed to any one of approximately 900 listed chemicals or heavy metals above a limit stated in the legislation. A Prop 65 warning does not mean a product is in violation of safety standards or requirements. Products displaying the warnings are perfectly safe to consume. Because Nutrtion53 powder contains heavy metals that are included on the Prop 65 list, the warning above must be communicated to be Prop 65 compliant.

The levels of the regulated compounds under Prop 65 are set at extremely low levels. Consequently, this warning statement may be familiar to anyone who has visited a restaurant, coffee shop, or take-out establishment in California. The warning statement is considered by many to be overly-emotive and not based on sound science even though the law dictates that it must be displayed.

Prop 65 Heavy Metals & Regular Foods

Tiny amounts of heavy metals are present in nearly all foods and drinks, naturally occurring within the soil in which some ingredients are grown. In 2014, the FDA published a five-year study (1) of heavy metals found in commonly bought grocery store items. This study showed that heavy metals were prevalent in a vast amount of food items. The levels are well below safe limits, of course, but many are over the Prop 65 levels (see table above).
